Beer Garden Kits Regulations and Ordnances

Whether it is a festival, parade, concert or tradeshow, Beer Gardens are useful for any event.

A Beer Garden is defined as an open area where beer and other alcoholic beverages are served or consumed. Generally, Beer Garden barriers promote safety and set restrictions to actions (such as underage drinking) and allows event staff to better monitor alcohol consumption.

Events that hold Beer Gardens prohibit possession and sale of any alcoholic beverage in parking lots or any other open area outside of the Gardens.

Though beer gardens help promote responsible alcohol consumption and lessen negative alcoholic actions at family-friendly events, each community has its own regulations and ordinances.

Before setting-up a Beer Garden, the sponsoring organization must obtain a Beer Garden license.

Generally, the area of a Beer Garden must be delineated by a fence for selling, serving and consuming beer or alcohol. Height restrictions vary by locations; however, some require the fence to be two four-foot high fences at least 72 inches apart. Other fence requirements include having the location of the establishment adjoining land use, lot and building size, and considering the proximity to residential properties and streets.

The purpose of the fence is to completely enclose the area that restrains the passage of any alcoholic drinks to another area that does not permit such drinks to be consumed. The only area permitted to be open includes space for ingress and egress. Upon entrance of any open space within the Garden, staff members and guards working the event are required to ID anyone entering the area.

Examples of Garden requirements set by some states include:

  • Restricting any Garden not placed within 200 feet of land zoned for human residence unless approved otherwise
  • Have a maximum capacity of one person for every ten net feet of the floor area
  • Prohibit any amplified sounds
  • Having hours of operation to be from 10 a.m. – 10 p.m.
  • Ban anyone under the age of 19 from entering the area
  • Barriers to be at least 6’ tall
